ProIV Unlimited – Customer Terms of Service
Acceptance of Terms
By accessing or using the ProIV Unlimited website, mobile application, or services (collectively, the “Service”), you confirm that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
Arbitration Notice:
You agree that any dispute between you and ProIV Unlimited will be resolved by binding individual arbitration, and you waive your right to a jury trial or class action.
If you have a medical emergency, call 911 or seek immediate in-person care. The Service is not appropriate for all conditions.
1. Who We Are
ProIV Unlimited (“we,” “us,” or “our”) operates a digital platform that allows users to schedule wellness and healthcare-related services. We do not provide medical care. Medical services are provided by independent, licensed medical providers and medical groups.
2. No Medical Care by ProIV Unlimited
ProIV Unlimited is not a medical provider and does not practice medicine. We facilitate scheduling, billing, and access to third-party providers, pharmacies, and laboratories.
Any diagnosis, treatment, prescription, or medical advice comes solely from licensed providers, not ProIV Unlimited. Use of the Service does not create a doctor-patient relationship with ProIV Unlimited.
3. Financial Responsibility / No Insurance
ProIV Unlimited and its medical partners do not accept insurance, Medicare, or Medicaid. All services are cash-pay only, and you are solely responsible for all charges.
4. Memberships & Subscriptions
Some services are offered through auto-renewing memberships or subscriptions. Your payment method will be charged automatically until canceled.
You must cancel at least 48 hours before renewal to avoid charges.
Memberships do not include travel or additional service fees unless stated otherwise.
5. Prescriptions & Labs
Certain services require a consultation and approval from a licensed provider. Prescriptions and lab services are provided by third-party pharmacies and laboratories. ProIV Unlimited is not responsible for their services, products, or packaging.
6. Payments
You authorize ProIV Unlimited and its payment processors to charge your payment method for all services, including recurring charges. All sales are final and non-refundable, except where required by law.
7. Eligibility
You must be 18 years or older to use the Service. Users aged 16–17 may only use the Service with verified parental consent. Users under 15 are prohibited.
Availability varies by location and applicable law.
8. Telehealth Consent
By using the Service, you consent to receive healthcare services via telehealth, where applicable, and acknowledge its limitations compared to in-person care.
9. Privacy
Your use of the Service is subject to our Privacy Policy. ProIV Unlimited is not a HIPAA-covered entity, though certain providers, pharmacies, or labs may be.
10. User Accounts & Security
You are responsible for maintaining the confidentiality of your login credentials and all activity on your account. Notify us immediately of unauthorized use.
11. Acceptable Use
You agree not to misuse the Service, violate laws, interfere with operations, submit false information, or engage in fraudulent, abusive, or harmful behavior.
12. Intellectual Property
All content, branding, logos, and materials associated with ProIV Unlimited are owned by us and may not be used without permission.
13. Third-Party Services
ProIV Unlimited is not responsible for third-party providers, products, or services. Any disputes with third parties are solely between you and them.
14. Disclaimers
The Service is provided “as is” and “as available.”
We make no warranties regarding accuracy, availability, or outcomes.
15. Limitation of Liability
To the fullest extent permitted by law, ProIV Unlimited’s total liability will not exceed $1,000. We are not liable for indirect, incidental, or consequential damages.
16. Indemnification
You agree to indemnify and hold harmless ProIV Unlimited and its partners from claims arising from your misuse of the Service or violation of these Terms.
17. Termination
We may suspend or terminate your access at any time for any reason. Certain provisions survive termination.
18. Arbitration & Class Action Waiver
All disputes will be resolved by binding arbitration on an individual basis only. No class actions are permitted. Arbitration will be governed by AAA rules.
19. Governing Law
These Terms are governed by the laws of the State of California and the Federal Arbitration Act.
20. Changes to Terms
We may update these Terms at any time. Continued use of the Service means you accept the updated Terms.
21. Entire Agreement
These Terms constitute the entire agreement between you and ProIV Unlimited regarding use of the Service.
